In this case the land tittle deed is a Nor Sor 3 Gor, which is the strongest tittle deed in Thailand after Chanote. This type of land may be sold, transferred, or mortgaged, the same as a Chanotte. The owner of the land may file a petition to the Land Department demanding to change it to a full Title Deed (Chanote), and the Land Department may do so if there is no opposition made against the petition.
As a foreigner buying land in Thailand, you should only consider land that comes with a Chanote, Nor Sor 3 or Nor Sor 3 Gor. These can be sold, leased and used as mortgage collateral and are the only titles over which a registerable right of ownership or lease can exist. More importantly, you cannot apply for or obtain approval to build on such land without one of the aforementioned titles. In any event, make sure you have a good lawyer look over the paperwork before you commit to anything.
The procedure for buy this project is the same as buying any other land for a foreigner. The most common option is to set up your own Thai Limited Company to own the land on your behalf, and you will have 100% of decision power on this. It’s perfectly legal and all the lawyers know very well the procedure. For the buyer it’s very easy, as all the needed paperwork are done by lawyers. With the same company, you will be able to buy the land, build, open and operate a resort on this land and to run it, as all other resorts on the island and in Thailand, it’s a very common and easy procedure.
The current owner of the land is a foreigner, who has a lot of businesses in the island. He will be able to discuss about the procedure.

All kind of commercial projects are possible and legal on this land, as on all other lands with proper tittle deeds in Thailand.
